Aquarium: Fish Business Empire is a free single-player fish tank game for Android. It has no accounts, no sign-in, no real-money purchases and no way for one player to reach another. It is paid for by optional rewarded video ads.
These terms are the agreement between you and LonkeroStudio for your use of the app. LonkeroStudio publishes this app from the EU and earns from it, so EU consumer law applies, and these terms are written to sit inside it. Where a term below would take away a protection the law gives you, the law wins and the term does not bind you (Article 22 of Directive (EU) 2019/770 and Article 6 of Directive 93/13/EEC).
1. Accepting these terms
By installing or playing the game you accept these terms. If you do not, do not install it, or uninstall it; that costs you nothing, because the app is free.
If you are under the age at which you can agree to terms like these where you live, a parent or guardian must agree on your behalf. The game is meant for players aged 13 and over.
Google Play's own terms apply to the download and to your dealings with Google. Nothing here changes them.
2. A consumer contract, even though it is free
You pay no money for the game. If you watch ads, the ad SDK processes personal data (see the privacy policy), and EU law treats that as a contract for the supply of digital content all the same (Directive (EU) 2019/770, Art. 3(1)). So you get the conformity rights in section 9 and the remedies in section 10.
3. Your licence to play
LonkeroStudio grants you a personal, non-exclusive, non-transferable, revocable licence to install and play the game on devices you control, for as long as these terms are in force. The app, its code, its art and its music stay ours (and, for third-party components inside it, their authors'). You get permission to play, not ownership.
Videos, streams and screenshots of you playing, including ones you earn money from, are allowed with no fee and no permission request. A credit to the game is welcome but not required.
4. Coins, gems, fish and other in-game items
Coins, gems, the Keeper's Pass, fish, eggs, decorations and everything else you earn or buy in the game are part of the game, not property. They have no cash value, cannot be exchanged for money or anything outside the game, and cannot be transferred, sold or traded between players. The in-game market is a game mechanic; its prices are set by the game, not by real buyers.
The game simulates living fish in real time: fish grow old and die of old age, and fish left unfed can die. That is how the game is meant to work and is not a fault.
We may rebalance prices, rewards and timings (see section 8). If a change would take away items you already have, the section 8 rules apply.
5. What you may not do
- Distribute, sell, rent or sublicense the app or a modified copy, or upload it to another store or download site.
- Reverse-engineer, decompile or disassemble the app, except as far as applicable law allows despite a term like this one (in the EU, including the interoperability and error-correction rights in Directive 2009/24/EC).
- Interfere with the advertising: automating, faking or scripting ad views or rewards, clicking ads to generate revenue, or running the app on emulator farms to do so. Ad fraud gets a small developer's ad account closed.
- Edit your save files or change your device clock to gain in-game items or time. The game signs its saves and protects its calendar; a save edited outside the game may be restored from its backup or have its values reset, and moving the clock backwards does not undo time already played. This is fair play, not punishment: it keeps the game's economy working.
- Use the app to break the law, or to attack or overload any service it talks to.
- Remove or alter any notice of ownership or licence in the app.
- Use "Aquarium: Fish Business Empire", "LonkeroStudio", the logo or the icon in a way that suggests we made, endorsed or are affiliated with something we did not.
6. Advertising
The game shows rewarded video ads only, and only when you tap a "watch an ad" button. Watching one to the end gives a small in-game reward. Ignoring them changes nothing else about the game.
The ads are served by Google AdMob. We do not choose or control the individual ads you see, and showing one is not an endorsement of the advertiser. What the ad SDK collects and how to limit it is in the privacy policy. If you see an ad that is illegal or deceptive, tell us and we will report it to Google.
7. Your saved game
Your tanks and progress are files in the app's private storage on your device. We do not hold a copy and cannot restore one. Android Auto Backup is switched off for this app, so uninstalling it, a factory reset, a device fault or a lost phone deletes your progress for good. There is no cloud save and no transfer between devices.
8. Updates and changes to the game
We may update the game. Beyond keeping it working, we may change it (add, alter or remove features, content and balance) only for these reasons:
- keeping it running on new Android versions, devices and screen sizes;
- fixing faults, security problems and crashes;
- balancing the economy and difficulty, including prices, rewards, timings and fish lifespans;
- complying with a change in the law, in Google Play's requirements, or in the terms of a component the app depends on.
Any such change is at no cost to you and is described in the release notes. If a change would affect how you access or use the game in more than a minor way, we will say so in advance and you may end these terms (uninstall) free of charge (Directive (EU) 2019/770, Art. 19).
We may stop publishing the game. A copy already installed keeps working until it does not.
9. Conformity
The game must be fit for the purpose a game of this kind is normally used for, have the features and quality you can reasonably expect, and match what we say about it on the store listing and in the game. If it does not, that is our responsibility, and you keep that protection although you paid no money. For a problem that appears within one year, it is for us to show the game was in conformity (Directive (EU) 2019/770, Art. 12(2)).
10. If the game is faulty
Tell us at the contact address, with your device and what happened.
- We fix it, free, within a reasonable time.
- If we cannot or do not, you may end this agreement, even for a minor fault (Directive (EU) 2019/770, Art. 14 and recital 67).
This does not take away any other right you have under the law of your own country, including any right to compensation.
11. Liability
We are liable to you as the law makes us liable. We do not exclude or limit liability for death or personal injury, intent or gross negligence, fraud, or anything else that cannot lawfully be excluded, and we do not limit your statutory consumer rights.
Subject to that, we are not liable for indirect or consequential loss or lost profit, or for in-game items lost other than through a fault in the game (a fault is a conformity question under section 9).
12. Ending these terms
You may end these terms at any time by uninstalling the app. We may end your licence if you seriously or repeatedly break section 5; because the app has no accounts or server, that means you must stop using it. Sections 5, 11 and 14 survive the end of these terms.
13. Changes to these terms
We may publish a revised version, and the "Last updated" date changes with it. The current version is at https://lonkerostudio.com/aquarium/terms/. A change does not apply to anything that happened before it and cannot take away a right the law gives you.
14. Governing law and disputes
These terms are governed by Finnish law, and the courts of Finland have jurisdiction. If you are a consumer, this cannot take away the protection of the mandatory law of the country where you live (Regulation (EC) No 593/2008, Art. 6(2)), and you may bring proceedings in your own country's courts.
Please write to us first. If we cannot settle it: in Finland, the Consumer Disputes Board (kuluttajariitalautakunta, https://www.kuluttajariita.fi/en/); elsewhere in the EU, your national consumer dispute body or the European Consumer Centre in your country.
15. General
If a provision is unenforceable, the rest stays in force. Not enforcing a term once does not waive it. These terms and the privacy policy at https://lonkerostudio.com/aquarium/privacy/ are the whole agreement about the app.
